What To Do If You Are In An Automobile Accident

Trusted Lafayette, Car Accident, Personal Injury Attorney

Many people believe that automobile or serious accidents happen to other people. Car and fatal accidents can turn a family upside down. Medical bills piling up, loss of work or wages, pain and suffering. If you or a loved one has been in a car accident there are steps you can take that will help your case.

Even if you are lucky and do not sustain serious injuries, there is a good chance that you will wake up the next day and feel like you were "hit by a truck". And then what do you do about the property damages to your vehicle, how do you get a rental vehicle, who will pay for the wrecker, where do you store your vehicle if it is a total loss, what repair shop should you use and what do you do when the insurance adjusters start to call?

Unfortunately, we live in a complicated society. If you are asking yourself these questions then you may need to consult with an attorney with experience dealing with these types of issues.

Important Steps to take if you have been injured in an Auto Accident:

Seek Medical Attention- your health is what is most important. If you have a primary care physician who is familiar with you and your family, then try to schedule an appointment with your family physician. Even if you were seen in the Emergency Room and are discharged, you will normally be given discharge instructions advising you to follow up with your primary care physician.

In the event your injuries are more severe and you are admitted to the hospital you may be seen by the emergency room physician, admitted to the hospital and cared for by the physicians that are "on call".

Follow your Doctor's Orders-schedule a doctor's appointment to make sure any or all injuries are uncovered. Many times an injury will occur several weeks after the accident. It is important to make sure to seek medical attention and get a complete physical. Hidden injuries that only manifest themselves days or even weeks after the initial trauma are common. If you have a pre-existing condition such as degenerative arthritis, you could have sustained an aggravation of your pre-existing condition. While Louisiana Law does not allow recovery for the underlying condition, you are allowed to recover for the aggravation of your pre-existing condition. Most states, including Louisiana, have a legal doctrine that you "take the victim as you find him". In other words, the person at fault is responsible for the damages he causes regardless of the condition of the victim.

Record Relevant Information, record weather or road conditions, obtain witness phone numbers and information, pictures of your vehicle, and even a diagram of the scene if possible.

Obtain a copy of the police report
